WRIT PETITION No.27977 OF 2025
O R D E R:
With the consent of both the parties, this Writ Petition is
being taken up for disposal at the admission stage itself.
2. This Writ Petition is filed under Article 226 of the
Constitution of India, seeking the following relief:
"...to issue Writ order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not considering the petitioners representations dated 21.08.2025, 25.08.2025, 21.08.2025 and 28.08.2025 in fixing the differential pay scale of the petitioners as Rs.23,740/- in the Pay Revision Commission, 2015 and the persons who were appointed at Eturunagaram, Mulugu District were fixed as Rs.25,840/- even though appointments are in pursuance of DSC, 2012 and also in not considering the request of the petitioners to extend the benefit as per Judgment of this Honourable High Court in WP No.42665 of 2017, dated 13.03.2025 as illegal, arbitrary, against Article 14, 16, 39(d) of the Constitution of India and consequently direct the respondents to re-fix the pay on par with appointees of the Eturunagaram, Mulugu District and as per Judgment of this Honourable Court in WP No.42665/2017, dated 13.03.2015 and pay all the benefits which are entitled to the petitioners and to pass..."
3. Heard Sri B. Nageshwarar Rao, learned counsel for the
petitioners and learned Government Pleader for Services-III
appearing for respondents.
4. Learned counsel for petitioners submits that the persons
who were appointed at ITDA-Utnoor, along with the petitioners in
the DSC, 2012 were getting higher pay than the petitioners and the
pay fixed at the time of their appointment i.e., April, 2013 is
Rs.21,230-63,030/- and as on April, 2017, the pay scale was fixed
at Rs.25,840-21,230-63,010/- and in the similar circumstances,
this Court in W.P.No.42665 of 2017 dated 13.03.2025 considered PK,J WP_27977_2025
the case of the petitioners therein and directed the respondents to
grant the same pay scale on par with their batch mates. Hence the
petitioners herein have made various representations to the
respondent Nos.3 to 7 on 21.08.2025, 25.08.2025 and 28.08.2025
with a request to grant the same pay scale to the petitioners,
however, no action has been taken by the respondents. Therefore,
the learned counsel for the petitioners seek indulgence of this
Court to direct the respondent Nos.3 to 7 to consider the same and
grant the same pay scale to the petitioners within a stipulated
period of time.
5. Learned Government Pleader submits that the
representations of the petitioners are pending with the respondent
Nos.3 to 7. The respondents will consider the same and pass
appropriate orders in accordance with law.
6. Having regard to the submissions made by both the learned
counsel for respective parties, this writ petition is disposed of
directing the respondent Nos.3 to 7 to consider the representations
of the petitioners dated 21.08.2025, 25.08.2025 and 28.08.2025 in
terms of the order dated 13.03.2025 passed by this Court in
W.P.No.42665 of 2017 as expeditiously as possible, preferably
within a period of six (6) weeks.

7. Accordingly, this writ petition is disposed of. There shall be
no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
