     THE HONOURABLE SRI JUSTICE N.TUKARAMJI

              WRIT PETITION No.16338 OF 2016

O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

"...to issue a Writ order or direction more particularly one in the nature of Writ of Certiorari call for the records pertaining to FIR.No.106 of 2016 dated 10.5.2016 of the 2nd respondent and declare the same is null and void and quash the same and pass such other order or orders in the interest of justice......"

2. Heard Mr.K.Hemalatha, learned counsel for the petitioners

and Mr.R.Laxmikanth Reddy, learned Assistant Government

Pleader for Home appearing for respondent Nos.1 to 3.

3. Learned counsel for the petitioners would submit that this

petition has filed seeking quashment of proceedings in Crime

No.106 of 2016. He would further submits that the petitioners

were shown as accused while they were found transporting the

PDS rice which said to have been purchased from the card holders

to do business with Sri Anjaneya Traders Rice and General

Merchants, Yellandu.

4. Learned Assistant Government Pleader for Home would

submit that during pendency of this petition, the FIR was

culminated into the C.C.No.222 of 2019 and after due trial

proceedings, the petitioners were acquitted vide judgment dated

04.11.2019 on the file of the learned Judicial Magistrate of First

Class, Yellandu, thus, cause does not subsist.

5. I have perused the materials on record.

6. Having regard to the development reported by the learned

Assistant Government Pleader, and as the crime itself has ended in

acquittal, cause does not survive for adjudication, accordingly, this

petition is dismissed as infructuous. There shall be no order as to

costs.

Miscellaneous Petitions, pending if any, shall stand closed.
