ORDER:
This petition is filed by the petitioner seeking transfer of H.M.O.P.No.19
of 2025 pending on the file of the Family Court-cum-III Additional District &
Sessions Judge at Nalgonda, to the Principal Family Court, Kalpataru,
Hyderabad.
2. Heard Sri B. Srikanth, learned counsel for the petitioner. In spite of
service of notice, there is no representation on behalf of the respondent. Perused
the entire record.
3. Learned counsel for the petitioner represented that the petitioner herein
has health issues and therefore, unable to travel to Nalgonda to defend
H.M.O.P.No.19 of 2025 pending on the file of the Family Court-cum-III
Additional District & Sessions Judge at Nalgonda.
4. In the circumstances stated, to facilitate the petitioner to defend H.M.O.P
and since there are catena of judgments of the Hon'ble Supreme Court to
consider the convenience of wife while transferring matters arising out of
matrimonial disputes, the relief sought for is granted.
5. In the result, the Transfer Civil Miscellaneous Petition is allowed and the
H.M.O.P.No.19 of 2025 pending on the file of the Family Court-cum-III RY,J Tr.CMP_262_2025
Additional District & Sessions Judge at Nalgonda, is withdrawn and transferred
to the Principal Family Court, Kalpataru, Hyderabad. The entire original record
shall be transmitted within a period of one month. There shall be no order as to
costs. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed.
