             WRIT PETITION No.33153 OF 2024


ORDER:

This Writ Petition is filed i) to declare the action of

respondent No.2 in not granting stay in M.A.No. of 2024

(un-numbered) in C.M.A.No. of 2024 (un-numbered) which

was filed on 08.11.2024 as illegal, ii) to grant stay of all

further proceedings including dispossession of the

petitioners from the lands in an extent of Ac.2.00 guntas

situated in Sy.No.448/2 and Ac.2.00 guntas in

Sy.No.448/1/1 and Sy.No.448/1/2 of Gate Karepally

Village, Singareni Mandal, Khammam District pursuant to

the proceedings No.LTR Case No.05/2023-SNGR, dated

03.08.2024 passed by respondent No.3 as illegal, arbitrary

and also violative of principles of natural justice and iii) to

grant stay of all further proceedings dated 03.08.2024

passed by respondent No.3, pending disposal of the said

appeal dated 08.11.2024.

2. Heard Sri Ramu Nallamothu, learned counsel for the

petitioners; learned Government Pleader for Social Welfare

Department, for respondent Nos.1 to 3 and Sri M.V. Venu,

learned counsel for respondent No.4.

3. Learned counsel for the petitioners submits that the

petitioners have filed an appeal dated 08.11.2024 before

respondent No.2 challenging the proceedings dated

03.08.2024 issued by respondent No.3. He further

submitted that initially the said appeal was unnumbered

and no stay was granted. However, it is now submitted that

the said appeal has been numbered and is now reserved for

judgment.

4. In view of the fact that the aforesaid appeal is now

numbered and reserved for judgment before respondent

No.2, this Court is of the opinion that no further orders are

required to be passed in the present Writ Petition at this

stage.

5. Accordingly, this Writ Petition is disposed of.

However, till the disposal of the aforesaid appeal, status-

quo existing as on today shall be maintained by both the

parties with regard to the subject property. No costs.

Miscellaneous petitions pending, if any, shall stand

closed.
