JUDGMENT:
Sri Mohammed Imran Khan, learned Additional
Advocate General, appears for the appellants.
Learned counsel Sri P.Govinda Rajulu appears for
respondent No.1.
Sri T.Venkat Raju, learned Government Pleader for
Labour Department, appears for respondent No.2.
2. Heard the learned counsel for the parties.
3. The appeal is against the interim direction of the
learned writ court asking the appellants, who are writ
petitioners, to deposit 50% of the salary of respondent No.1
- workman (hereinafter referred to as, "the workman"), as
per the Award dated 30.04.2024 passed in favour of the
workman, pending adjudication of the writ petition.
4. Learned Additional Advocate General appearing for
the appellants, though sought to raise the issue of
maintainability of the Industrial Dispute before the Labour
Court, but has confined himself to the interim direction of
pre-deposit passed by the learned writ court. He submits
that the appellants are ready to make the pre-deposit, but
it will be in the interest of both the parties if the amount is
not withdrawn during the pendency of the writ petition.
5. Learned counsel for the workman has also drawn the
attention of this Court to the merit of the dispute which, in
the present appeal, we are not required to go into in view of
the pendency of the writ petition.
6. However, we deem it proper to observe that the
appellants should abide by the interim direction passed by
the learned writ court, but at the same time, the workman
should not withdraw the amount in question till the writ
petition is decided. The learned writ court, if deems
appropriate, to direct the deposit to be kept in an interest
bearing account under the Registrar General of this Court.
7. With the aforesaid observations, the instant appeal is
disposed of. Let it be made clear that there is no
observation touching the merits of challenge before the
learned writ court. However, there shall be no order as to
costs.
Miscellaneous applications pending, if any, shall
stand closed.
