CRIMINAL PETITION No.4330 of 2025
ORDER:
This Criminal Petition is filed by the petitioner-accused
under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for
short 'BNSS, 2023'), challenging the order dated 11.02.2025 passed
in Crl.M.P.No.189 of 2025 in C.C.No.3617 of 2019 by the learned II
Additional Junior Civil Judge at Khammam. By the impugned order,
the petition filed by the petitioner-accused under Section 39 of
Bharatiya Sakshya Adhiniyam, 2023 (previously Section 45 of the
Indian Evidence Act, 1872) was dismissed.
2. When the matter is taken up for hearing, it is brought to
the notice of this Court by Mr. Annapurna Sreeram, learned counsel
for respondent No.2 that the trial Court has convicted the petitioner-
accused imposing a sentence of six months imprisonment and the
matter is no more pending before the trial Court. Therefore, the
present criminal petition becomes infructuous.
3. On verification of eCourt status, it discloses that the
judgment was delivered in the said C.C. on 06.05.2025 convicting
the petitioner-accused.

4. In view of the above, this Criminal Petition is dismissed
as infructuous.
Miscellaneous petitions, pending if any, shall stand
closed.
