JUDGMENT:
Learned counsel Sri K.Sudhakar Reddy appears for
appellant No.2.
Sri N.Bhujanga Rao, learned Deputy Solicitor General
of India, appears for the respondents.
2. Heard learned counsel for the parties.
3. The appeal suffers from a delay of 562 days. The
only explanation in the delay condonation application is at
paragraph 3, which is extracted hereunder:
"I respectfully submit that, I am a widow and coming from a poor family background and I am not aware of legal proceedings that to my husband was suspended on 11.06.2010 and thereafter died on 30.01.2011, I am unable to run my family without any source of income. I could not take a decision immediately and contact my counsel Sri K.Sudhakar Reddy for filing of appeal against the learned Single Judge order passed in W.P.No.6023 of 2011, dt.20.03.2024. In this connection there is a delay in
filing writ appeal against the said order. The said delay is neither wilful nor wanton but circumstances explained above."
4. The impugned judgment has been passed on
20.03.2024. The explanation furnished relates back to the
death of the employee in January 2011. Such inordinate
unexplained delay, therefore, cannot be condoned.
5. The interlocutory application seeking condonation of
delay is, therefore, dismissed. Consequently, the appeal is
also dismissed.
