                  W.P.No.903 of 2025


     This writ petition is filed questioning the action of

the respondent No.3 in refusing to receive, register and

release the sale deed presented by the petitioner in

respect of property bearing H.No.4-1127 in Sy.No.80

admeasuring 50 sq. yards situated at Marthanda Nagar,

Hafeezpet, Serlingampally, Ranga Reddy District as illegal

and arbitrary.

2. Heard learned counsel for the petitioner and learned

Assistant Government Pleader for Stamps and

Registration.

3. Learned Counsel for the petitioner submits that the

respondent No.3 is refusing to receive, register and

release the sale deed in respect of the subject property in

spite of the Judgment and Decree passed in O.S.No.1781

of 2015 on the file of II Additional Senior Civil Judge,

Ranga Reddy District dated 05.08.2019 and also the

order passed in E.P.No.66 of 2022 in O.S.No.1781 of 2 SK, J

2015 on the file of the Senior Civil Judge, Ranga Reddy

District at Kukatpally dated 14.07.2023 and requested to

direct the respondent No.3 to receive and register the

document presented by the petitioner.

4. Learned Assistant Government Pleader for Stamps

and Registration, on instructions, submits that so far the

petitioner has not presented any document before the

registering authority and if the same is submitted, they

will receive the same and pass appropriate orders as per

law.

5. In view of the submission made by the learned

Assistant Government Pleader, the Writ Petition is

disposed of directing the petitioner to present the sale

deed before the respondent No.3, and on receipt of the

same, the respondent No.3 is directed to receive and

process the said sale deed submitted by the petitioner

subject to the petitioner complying with the provisions of

the Indian Registration Act, 1908, and Indian Stamps

Act, 1899, as expeditiously as possible, preferably within 3 SK, J

a period of four (4) weeks from the date of receipt of a

copy of this order. It is also open to the Registering

Authority to refuse to register the document by

specifically assign the reasons and communicate the said

decision to the petitioner. There shall be no order as to

costs. the said sale deed and pass appropriate orders as

per law. No order as to costs.

6. Miscellaneous Applications, if any pending in this

writ petition, shall stand closed.
