WRIT APPEAL No.322 of 2025
JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):
Sri Rapolu Bhaskar, learned counsel for the appellant.
2. In this writ appeal, the appellant is aggrieved by the order
dated 03.03.2025 passed in W.P.No.6346 of 2025.
3. During the course of hearing, learned counsel for the
appellant agreed that this writ appeal may be disposed of by
modifying paragraph No.5 of the impugned order passed by the
learned Single Judge. It may be observed that after inspecting the
site of the appellant, the report, which shall be prepared, may be
supplied to the appellant and if the respondents intend to take any
adverse action against the appellant, he may be heard before taking
any such action.
4. In view of this statement, we deem it proper to dispose of
this writ appeal by maintaining the impugned order and by adding
that after the inspection, if the report of the site is against the
appellant, respondent No.4 shall provide a copy of report and
afford an opportunity of hearing to the appellant before taking a
final decision on the said report.
5. With the aforesaid observation, the writ appeal is disposed
of without expressing any opinion on the merits of the case. No
costs.
Interlocutory applications, if any pending, shall also
stand closed.
