JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri P. Sai Manideep, learned counsel represents

Sri M. Vishnuvardhan, learned counsel for the appellant,

Sri G. Madhusudhan Reddy, learned counsel for respondent

Nos.1 to 4/writ petitioners, Sri Muralidhar Reddy Katram,

learned Government Pleader for Revenue, for respondent Nos.5

to 9 and Sri M. Vishnu Prasad, learned counsel represents

Ms. R. Madhavi Latha, learned counsel for respondent Nos.10 to

13.

2. With the consent, finally heard.

3. During the course of hearing, learned counsel for the

parties reached to a consensus. It is agreed that admittedly, the

present appellant preferred an appeal under Section 5(5) of the

Andhra Pradesh Rights in Land and Pattadar Pass Books Act,

1971 (for short, "the Act"). Learned Single Judge came to hold

that the appeal was not entertainable as on the date of filing of

appeal under Section 5(B) of the Act. It is agreed that since the

appeal was preferred under Section 5(5) of the Act and learned

Single Judge has not examined as to whether the appeal is

tenable under the said section, the impugned order dated

29.11.2024 passed in W.P. No. 7400 of 2019, may be set aside

and the matter may be remitted back to the learned Single Judge

to decide it afresh in accordance law.

4. In view of consensus arrived at, the impugned order

dated 29.11.2024 is set aside. W.P No. 7400 of 2019 is restored

to its original number. Learned Single Judge may decide the said

writ petition afresh in accordance with law.

5. Accordingly, this Writ Appeal is disposed of without

expressing any opinion on merits of the case. No costs.

Interlocutory applications, if any pending, shall also

stand closed.
