COMMON JUDGMENT:
(Per Hon'ble Justice Moushumi Bhattacharya)
1. The parties are present in Court. Counsel representing
the parties placed a Memorandum of Understanding dated
27.10.2024 followed by a Memorandum of Joint Compromise
dated 12.06.2025 by which the parties have agreed to settle
their disputes and differences. All three F.C.As are mentioned
in the Memorandum of Joint Compromise in Paragraph Nos.2, 3
& 4 therein.
2. Counsel for the appellant submits that the parties now
intend to file for mutual divorce. The Trial Court, in one of the
impugned orders from which F.C.A.No.203 of 2019 arises, has
already dissolved the marriage between the parties. Hence, it is
not understood why the parties would seek mutual divorce.
3. In any event, the three FCAs are disposed of in terms of
the Memorandum of Understanding and the Memorandum of
Joint Compromise (I.A.No.1 of 2025) as stated above. Interim
MB,J & BRMR,J I.A.No.1 of 2025 in /and FCA.Nos.203, 204 & 257 of 2019
orders, if any, shall stand vacated. All connected applications
are disposed of. No order as to costs.
4. The parties are at liberty to approach the Trial Court for
any other relief as they may be advised.
