WRIT PETITION No.17218 OF 2025
ORDER:
With the consent of both the parties, this Writ Petition is
disposed of at the admission stage itself.
2. Heard Sri K. Venumadhav, learned counsel for the petitioner
and Sri A. Chandra Shaker, learned Standing Counsel for NPDCL,
appearing for the respondents. Perused the material on record.
3. Brief facts of the case are that the petitioner is presently
working as an Assistant Lineman at Mubarak Nagar, Nizamabad.
While working as a Lineman at LM/D-II/Nizamabad, the petitioner
was placed under suspension by respondent No.3 through Memo
No.DEE/Op/Nzb/JAO/Adm/F.No.46/2015, dated 01.05.2015, on the
ground of grave charges, pending enquiry. Following the enquiry,
respondent No.3 imposed a punishment through Memo
No.DEE/Op/Nzb/JAO/Adm/E2/D.No.1666/2017, dated 30.10.2017,
reducing the petitioner to the lower cadre of Assistant Lineman for
a period of three years and treating the suspension period as such.
Upon completion of the said punishment on 29.10.2020,
the petitioner was reinstated to duty on 30.10.2020. However, the
petitioner was neither permitted to discharge duties as a Lineman
nor paid the corresponding salary, and was also excluded from the
eligible list of Linemen for promotion to the post of Line Inspector in
October 2024.
4. A criminal case in F.I.R. No.342 of 2012 was registered at
Kamareddy Police Station. After completion of the investigation,
a charge sheet was filed and the case was numbered as C.C.No.533
of 2014 on the file of the Principal Junior Civil Judge-cum-Judicial
Magistrate of First Class at Kamareddy. The case ended in acquittal
through judgment dated 20.11.2024. The petitioner submitted
detailed representations dated 04.09.2023 and 15.04.2025 to the
respondent authorities seeking restoration of original pay, seniority,
increments, and promotion, but no action was taken despite the
petitioner's superannuation on 30.06.2025. Aggrieved by the same,
the petitioner filed the present Writ Petition.
5. Learned counsel for the petitioner submits that appropriate
orders may be passed in this Writ Petition by directing the
respondents to consider the representations submitted by the
petitioner on 04.09.2023 and 15.04.2025 and pass appropriate
orders in accordance with law within a reasonable period.
6. Learned Standing Counsel for NPDCL, appearing for the
respondents, submits that he has no objection for the disposal of
the representations of the petitioner dated 04.09.2023 and
15.04.2025.
7. Taking into consideration the submissions made by the
learned counsel for the respective parties, without expressing any
opinion on the merits of the case, this Writ Petition is disposed of
directing the respondent authorities to consider the petitioner's
representation dated 15.04.2025 and pass appropriate orders in
accordance with law, as expeditiously as possible, preferably within
a period of six (6) weeks from the date of receipt of a copy of this
order. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, in this
Writ Petition, shall stand closed.
