JUDGMENT:

(Per the Hon'ble Sri Justice Abhinand Kumar Shavili)

When the matter is taken up for hearing, learned

counsel appearing for the appellant has informed the

Court that though learned counsel for the appellant

has informed her that the case is coming up for

hearing on 03.01.2025, she has not given any

instructions to proceed with the case. Therefore,

appropriate orders be passed to that effect.

This Court is of the considered view that since the

learned counsel for the appellant has informed the

appellant that the case is coming up for hearing on

03.01.2025, and the appellant having been informed

about the same, has not instructed her counsel to

proceed with the case.

In view of the same, this Court has no other

option except to dismiss the case for default or non-

prosecution.

Accordingly, the Appeal is dismissed for default.

No order as to costs.

As a sequel, miscellaneous applications pending

if any, shall stand closed.
