WRIT APPEAL No.119 of 2025
JUDGMENT:
(Per the Hon'ble the Acting Chief Justice Sujoy Paul)
Sri Rapolu Bhaskar, learned counsel for the appellant,
Sri Y.Ashok Raj, learned counsel for respondent No.1 and
Ms.Tekuru Swetcha, learned Assistant Government Pleader for
Revenue for respondent Nos.3 to 5.
2. With the consent, finally heard.
3. During the course of hearing, learned counsel for the parties
reached to a consensus. It is agreed that when the learned Single
Judge relegated the parties to avail the remedy under civil law, it
was not proper to pass directions contained in paragraph No.19 of
the impugned order dated 10.09.2024 passed in W.P.No.5265 of
2008, which amounts to giving interim protection. It is agreed
that paragraph No.19 of the impugned order may be set aside by
reserving liberty to the parties to file appropriate civil
suit/injunction application before the Court of competent
jurisdiction for their grievance.
4. Accordingly, paragraph No.19 of the impugned order dated
10.09.2024 passed in W.P.No.5265 of 2008 is set aside and the
writ appeal is disposed of by reserving liberty, as prayed for. No
order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
