                    WRIT APPEAL No.149 of 2025

JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri N. Sheshidhar, learned counsel for the appellant and

Sri Ananthsen Reddy, learned Government Pleader for Industries

and Commerce Department, for respondent Nos.1 and 2.

2. The challenge mounted in this Intra-Court appeal is to the

order dated 21.11.2024 in W.P.No.32605 of 2024 passed by a

learned Single Judge.

3. Learned counsel for the appellant submits that the

appellant's Writ Petition was disposed of mainly for two reasons.

The first reason is that the appellant has not approached the

Facilitation Council through registration Portal. On the basis of

two documents/screenshots of said Portal (page Nos.43 and 44),

learned counsel submits that the said finding is incorrect.

Secondly, it is submitted that two memos dated 02.07.2021 and

01.09.2021 mentioned in paragraph No.4 of the impugned order do

not debar the appellant to prefer such application.

4. On a specific query from the Bench, learned counsel for the

appellant fairly admitted that the aforesaid two

documents/screenshots of Portal were not filed along with the Writ

Petition and were not brought to the notice of the learned Single

Judge. Thus, the appellant can bring those two

documents/screenshots to the notice of the learned Single Judge

by filing a review petition. The other points raised can also be

canvassed before the learned Single Judge.

5. Accordingly, this Writ Appeal is disposed of by reserving

liberty to the appellant to file a review petition before the learned

Single Judge. It is made clear that this Court has not expressed

any opinion on the merits of the case. No costs.

Interlocutory applications, if any pending, shall also

stand closed.
