                 CRIMINAL APPEAL No.26 OF 2013

ORDER:

This Criminal Appeal has been filed by the Appellant/accused No.2,

aggrieved by the judgment passed by the learned Special Session Judge

for the Trial of cases under S.Cs and S.Ts (P.O.A) Act-cum-VII

Additional District and Sessions Judge, Mahabubnagar, dated 25.05.2012,

whereunder, the appellant/accused No.2 was convicted for the offences

under section 307 r/w 34 of the Indian Penal Code, 1860 (for short 'IPC')

and section 3(2)(v) of the Scheduled Castes and Scheduled Tribes

(Prevention of Atrocities) Act, 1989 (for short SCs' and STs' (POA) Act)

and sentenced to undergoes rigorous imprisonment for a period of five

years and to pay fine of Rs. 500/-, in default of payment of fine, he shall

suffer simple imprisonment for a period of one month for the offence

under section 307 r/w 34 of the IPC and also sentenced to undergoes

rigorous imprisonment for a period of five years and to pay fine of

Rs.1000/-, in default of payment of fine, he shall suffer simple

imprisonment for a period of one month for the offence under section

3(2)(v) of the SCs' and STs' (POA) Act. However, it was directed that all

the sentences shall run concurrently. The period of judicial custody

undergone by the accused shall be set off against the sentence undergone

during period of trail under Section 428 of the Code of Criminal

Procedure, 1973.

2. When this matter was taken up for hearing on 21.8.2025,

Mrs.P.Radhika, legal aid counsel, appearing on behalf of

appellant/accused No.2, basing upon the information furnished by the

Legal Services Committee as well as the concerned police officials,

submitted that during the pendency of this appeal, the appellant/accused

No.2 was released on remission by order dated 19.04.2016. By virtue of

the same no further adjudication is required. However, at request of the

learned Assistant Public Prosecutor, for getting instructions, the matter

was posted to today under the caption 'for orders'.

3. Today, the learned Assistant Public Prosecutor, submitted that the

appellant/accused No.2 was released on expiry of sentence from the prison

on 19.04.2016, after earning (407) days rules remission rules as per

Telangana State Prison Rules, 1979. A copy of the details of release of the

convict prisoner, issued by the Superintendent, Central Prison, Cherlapalli,

dated 21.08.2025, has been placed before this Court.

4. Taking into consideration the above facts and circumstances of the

case, this Court is of the considered view that no further adjudication is

required in this criminal appeal.

5. Accordingly, the criminal appeal is closed.

Miscellaneous Petitions, pending if any, shall stand closed.
