                      CRIMINAL APPEAL No.216 OF 2012


ORDER:

This Criminal Appeal has been filed aggrieved by the judgment

passed by the learned Assistant Sessions Judge, Miryalaguda in S.C.

No.130 of 2001 dated 24.05.2004 whereunder the respondent Nos.1 to

3 were acquitted for the offences punishable under Sections 304-B and

201 of IPC.

2. Heard Mr. Vivekanand Reddy, learned Assistant Public

Prosecutor and Mr. Md. Haneef, learned Counsel representing Mr. Kiran

Reddy Mallarapu, learned Counsel appearing on behalf of respondent

Nos.1 to 3.

3. During the course of hearing, learned Assistant Public Prosecutor

fairly submits that P.W-1 viz., G. Venkata Satyanaraya, aggrieved by the

judgment passed by the learned Assistant Sessions Judge,

Miryalaguda., Nalgonda in S.C. No.130 of 2001 dated 24.05.2004

whereunder the respondents herein were acquitted for the offences

punishable under Sections 304-B and 201 of IPC had approached the

erstwhile High Court of Andhra Pradesh, Hyderabad and the said

Revision Petition was dismissed on 15.07.2011 and the learned

Additional Public Prosecutor placed the copy of the said order before

this Court.

4. After perusal of the above said order, it reveals that the State filed

the present Appeal, aggrieved by the very same judgment passed by the

learned Assistant Sessions Judge, Miryalaguda in S.C. No.130 of 2001

dated 24.04.2004. By virtue of confirming the order passed by the trial

Court in Crl.R.C. No.1467 of 2004 dated 15.07.2011, this Court is of

the considered view this Criminal Appeal is liable to be dismissed

especially even according to the parties, the order passed by the

erstwhile High Court of Andhra Pradesh dated 15.07.2011 in Crl.R.C.

No.1467 of 2004 has become final.

5. Accordingly, the Criminal Appeal is dismissed.

Miscellaneous petitions, if any, pending in the Criminal Petition,

shall stand closed.
