Citation : 2025 Latest Caselaw 5110 Tel
Judgement Date : 25 April, 2025

Telangana High Court

Smt Zeenath Sajeeda Begum, vs Haridaspally Ramaiah on 25 April, 2025

HON'BLE SRI JUSTICE C.V. BHASKAR REDDY

CIVIL REVISION PETITION No.1510 of 2025

ORDER:

This Civil Revision Petition is filed under Article 227 of the

Constitution of India, seeking a direction to the Junior Civil

Judge, Parigi, Vikarabad District to dispose of O.S.No.225 of

2024 within a specified time.

2. It is stated that the petitioners herein are the plaintiffs in

O.S.No.225 of 2024, which was filed for declaration to declare

that the plaintiffs are absolute owners of the land admeasuring

Acs.3.27 guntas in Sy.No.208/E/3, situated at Chiguralpalle

Village, Pargi Mandal, Vikarabad District and to deliver its

vacant possession to the plaintiffs. It is further stated that the

defendants were set ex parte on 20.12.2024 and since the

defendants have not filed any petition to set aside the said ex

parte order, the trial Court has posted the suit 'for judgment' to

10.03.2025. The grievance of the petitioners is that even after

posting the matter 'for judgment', the trial Court did not

pronounce the judgment and therefore, they sought for

expeditious disposal of the said suit.

3. Heard Sri Soma Ravi Kiran Reddy, learned counsel for the

petitioners and in view of the relief sought for in this Civil

CVBR, J Crp_1510_2025

Revision Petition, issuance of notice to the respondents is

dispensed with.

4. As seen from the record, prima facie it appears that the

petitioners have instituted the suit for declaration in the year

2024 and the defendants were set ex parte on 20.12.2024. As

the defendants have not filed any application to set aside the ex

parte order, the trial Court heard the petitioners and posted the

said suit 'for judgment'. Since the suit, which is posted 'for

judgment' pertains to the year 2024, this Court does not find

any legal infirmities warranting interference of this Court under

Article 227 of the Constitution of India to direct the trial Court

to pass orders as desired by the petitioners in this revision and

hence, this C.R.P. is misconceived and is liable to be dismissed.

5. Accordingly, this Civil Revision Petition is dismissed.

There shall be no order as to costs.

6. As a sequel, the miscellaneous petitions pending, if any,

shall stand closed.
