JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri V. Vishwanath, appellant, party-in-person;

Sri G. Madhusudhan Reddy, learned Standing counsel for

GHMC, for respondent Nos.3 to 5 and Sri Mahesh Raje,

learned Government Pleader for Home Department, for

respondent No.7.

2. Party-in-person submits that the situation at the

ground is like that he cannot use even fan because of

activity of tiffin centre. His wife is ailing. Thus, interference

may be made.

3. It is seen that learned Single Judge has permitted

the party-in-person in W.P.No.7883 of 2025 to take out

personal notice on respondent No.8 and posted the matter

on 07.04.2025. Learned Single Judge is yet to consider the

interim prayer sought for in the writ petition. The matter is

listed shortly on 07.04.2025. The Writ Appeal is not

maintainable against this kind of interlocutory order in view

of the judgments of the Supreme Court in Shah Babulal

Khimji v. Jayaben D.Kania1, Midnapore Peoples' Coop.

Bank Ltd. v. Chunilal Nanda 2 and Shyam Sel And Power

Limited v. Shyam Steel Industries Limited3, which are

recently followed by this Court in W.A.No.82 of 2025 and

batch.

4. Accordingly, this Writ Appeal is dismissed as not

maintainable. However, the appellant is free to press his

interim prayer before the learned Single Judge on

07.04.2025.

Interlocutory applications, if any pending, shall also

stand closed.
