                 APPEAL SUIT No.448 of 2008

J U D G M E N T:

This appeal suit is filed against the Judgment and decree

dated 23.03.1998 passed in O.S.No.52 of 1993, by the learned

Senior Civil Judge, Miryalaguda.

2. The suit vide O.S.No.52 of 1993 was filed by the

appellant-plaintiff against the respondents-defendants for

partition and separate possession. In the trial Court, after

considering the entire evidence on record, dismissed the suit.

Aggrieved by the same, plaintiff therein preferred the present

appeal.

3. On 20.10.2023 there is no representation on behalf of the

learned counsel for the appellant and thus the matter was

directed to be listed under the caption "for dismissal" on

14.11.2023.

4. Today when the matter is taken up, there is no

representation on behalf of the learned counsel for the appellant

even after listing the matter under the caption "for dismissal"

and not evinced any interest in pursuing the matter. Learned

counsel for respondents is present.

5. Hence no purpose would be served in continuing the

present appeal and accordingly the appeal suit is dismissed for

non-prosecution. No order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall

stand closed.
