                WRIT PETITION No.28713 of 2022
ORDER:

Heard learned counsel for the petitioner and the learned

Assistant Government Pleader for Home.

2. Learned counsel for the petitioner submitted that the rowdy

sheet was opened against the petitioner on the basis of the

following crimes:

1. Cr.No.1188 of 2003 registered for the offences under Section 364, 302, 201 and 120-B IPC with the S.R. Nagar Police Station, Hyderabad. The Police filed charge sheet and the same was numbered as PRC.No.61 of 2011 and later numbered as SC.No.28 of 2012 and the same ended in acquittal vide judgment dated 02.03.2009 on the file of the I Additional Metropolitan Sessions Judge, Hyderabad.

2. Cr.No.148 of 2006 registered for the offences under Sections 25(1)(b) of Arms Act and the same was numbered as C.C.No.1206 of 2008 and acquitted by the XVI Additional Chief Metropolitan Magistrate, Hyderabad vide judgment dated 31.01.2014.

3. Cr.No.42 of 2004 registered for the offence under Sections 364-A read with 120-B IPC and the same was numbered as S.C.No.561 of 2004 and this Court acquitted the petitioner vide judgment dated 09.07.2018 in CRLA.No.1058 of 2011.

3. As seen from the above, the first case ended in acquittal in

2009, the second case ended in acquittal in the year 2014 and the

third case ended in acquittal on 09.07.2018. As the petitioner was

acquitted in all the three cases, the continuance of rowdy sheet

against the petitioner is not justified and unsustainable.

Hence, the writ petition is allowed and the respondents are

directed to close the rowdy sheet opened against the petitioner.

Pending miscellaneous petitions, if any, shall stand closed.

There shall be no order as to costs.
