JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an order
dated 19.09.2017 passed by the learned Single Judge in
W.P.No.32038 of 2017.
The facts of the case reveal that the writ petition was
preferred being aggrieved by the order dated 04.09.2017
directing the appellants/writ petitioners to shift their
school and the appellants/writ petitioners came up before
this Court stating that they have submitted an application
under the Building Regularisation Scheme for
regularisation of the unauthorised construction. The
learned Single Judge has declined to interfere with the
order passed by the District Educational Officer on the
ground that safety of children, who are studying in the
school, is involved in the matter. However, the
respondents were directed to consider the grievance of the
appellants/writ petitioners for granting them some
reasonable time to shift the school from the premises in
question.
This Court does not find any reason to interfere with
the order passed by the learned Single Judge.
The writ appeal is accordingly dismissed.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
