WRIT APPEAL No.261 OF 2012
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
21.07.2009
passed in W.P.No.17269 of 2008.
The facts of the case reveal that a writ petition i.e.,
W.P.No.17269 of 2008 was preferred by P. Nani along with
Yiceroy Hotel Employees Union being aggrieved by the transfer
order dated 25.06.2008 transferring the first writ petitioner
from Hyderabad to Chennai.
The learned Single Judge has dismissed the writ petition
against which the Viceroy Hotel Employees Union has filed the
present writ appeal and the employee, who was affected by the
transfer order, has not filed any writ appeal. The employee in
question has already carried out the transfer order and
therefore, this Court is of the opinion that no further orders are
required to be passed in the present writ appeal. The employee
who was aggrieved in the matter has also not preferred any writ
appeal.
Accordingly, the writ appeal is dismissed. However, the
question of law is left open.
Miscellaneous applications pending, if any, shall stand
closed. There shall be no order as to costs.
