WRIT APPEAL No.189 OF 2022
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel was fair enough in stating before this
Court that the statutory provisions as contained under Section
17 of the National Council for Teacher Education Act, 1993 (for
short, "the Act"), stipulate that the order withdrawing/refusing
recognition passed by the Regional Committee shall come into
force only with effect from the end of the academic session next
following the date of communication of such order. He has
stated that in the present case there is violation of Section 17.
Prima facie, it appears there is violation of Section 17 of
the Act.
In the light of the aforesaid, no case for interference is
made out in the matter in respect of the interim order passed by
the learned Single Judge.
Accordingly, the writ appeal stands dismissed with a
liberty to the parties to argue all possible grounds raised in the
writ petition, which is pending for final adjudication.

Miscellaneous applications pending, if any, shall stand
closed. There shall be no order as to costs.
