JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel for the Income Tax Department is
fair enough in informing this Court that similar appeal i.e.,
ITTA No.60 of 2022 involving the same assessee for the
assessment year 2010-2011 has already been dismissed by
a Division Bench of this Court on 03.03.2022.
The Division Bench of this Court has considered the
substantial questions of law involved in the present appeal
also in ITTA No.60 of 2022 and therefore, no further orders
are required to be passed in the present appeal.
The judgment delivered in ITTA No.60 of 2022, dated
03.03.2022
, shall be applicable mutatis mutandis in the
present case also.
The present appeal is accordingly dismissed. Let a
copy of the judgment passed by the Division Bench of this
Court in ITTA No.60 of 2022, dated 03.03.2022, be kept on
record in the present case.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
