      THE HONOURABLE SRI JUSTICE K.SURENDER
               CRIMINAL APPEAL NO.70 OF 2020

ORDER:

This Criminal Appeal is filed under Section 378 (4) of Code of

Criminal Procedure, 1973 (for short "Cr.P.C") seeking set aside the

Judgment of acquittal dated 02.12.2019 passed by XV Special

Magistrate, Hyderabad in C.C.No.279 of 2019 (Old C.C.No.4856 of

2019) and to pass such other order.

2. Learned counsel for the appellant was absent on 12.04.2022

and though directed proof of service is not filed. When the case was

listed on 23.06.2022, he was again absent, inspite of directions and

the relevant papers and proof of service are also not filed. Hence,

the case is posted to this date under the caption "For dismissal".

Even today none appears. It appears from the conduct of the

appellant that the appellant is not interested in prosecuting the said

appeal.

3. Accordingly, the Criminal Appeal is dismissed for non-

prosecution.

Crl.Appeal No.70 of 2020

Miscellaneous applications, if any pending in this petition, shall

stand dismissed.
