SECOND APPEAL No.20 OF 2017
JUDGMENT :
1. Learned counsel for the appellant called absent. No
representation.
2. Learned counsel for the second respondent present. As
per proceedings dated 19-04-2022, respondent Nos. 1 and 3 to
5 reportedly died and the respondent No. 5 is being
represented by respondent Nos. 6 to 9. Accordingly, fresh
notice was ordered. Personal notice is also permitted against
the respondent Nos. 6 to 9.
3. But, as per the available material of record, the
appellants failed to take out notice as directed. It is also
evident from the proceedings dated 19-04-2022 also the
appellant remained absent without any representation. In that
view of the matter, as the appellants are not evincing any
interest and also failed to take out notice to the respondent
Nos. 6 to 9 as directed, I do not find any merit to adjourn the
matter.
4. Accordingly, this appeal is dismissed for default for
non-prosecution.
5. As a sequel, miscellaneous applications, if any,
pending, in this second appeal, shall stand closed.
