SECOND APPEAL NO.1037 OF 2000
JUDGMENT:-
1.
The present Second Appeal is filed aggrieved by the
judgment and decree dated 18.01.1999 in A.S.57 of 1994, on
the file of I Additional District & Sessions Judge at Nalgonda,
confirming the decree and judgment dated 07.12.1994 in
O.S.No.531 of 1991, on the file of District Munsif at Nalgonda.
2. The learned counsel appearing for the appellant filed a
memo dated 07.06.2022 on the last date of hearing reporting
that he has no instructions from his client to proceed with the
matter. Upon such instruction, he was directed to send notice
to the client about his discontinuation. Today, when the matter
is taken up for hearing, there is no representation from the
counsel for appellant and the directions given by this Court are
not complied with inspite of the matter being listed under the
caption "For Dismissal". Therefore, this Court is inclined to
dismiss the appeal for non-prosecution.
3. In the result, the Second Appeal is dismissed for non-
prosecution. There shall be no order as to costs.
4. Miscellaneous petitions, if any pending, shall stand closed.
