                    WRIT PETITION No.15461 of 2019

ORDER:

This Writ Petition is filed seeking a mandamus to declare the action of

respondent Nos.2 to 4 in not giving protection to the petitioner to cultivate his

land in Survey No.98/12 to an extent of Ac.0.10 guntas and in Survey

No.98/13 to an extent of Ac.0.10 guntas situated at Bejjikal Village,

Tripuraram Mandal, Nalgonda District, in the light of the decree and

permanent injunction granted in O.S.No.11 of 2017, dated 08.08.2018, and

threatening the petitioner not to enter into his land in the instance of

respondent No.5, as illegal and arbitrary.

2. When the matter came up for admission, this Court by order dated

31.07.2019, has directed the 3rd respondent - Inspector of Police, Anumula

Police Station, Nalgonda District, to provide necessary police aid to the

petitioner, provided the judgment and decree dated 08.08.2018 in O.S.No.11

of 2017 is in subsistence.

3. Sri S.Rama Mohan Rao, learned Assistant Government Pleader for

Home, submits that as per the orders passed by this Court, the respondent

police provided police protection.

4. Sri Rapolu Bhaskar, learned counsel for the unofficial respondent No.5,

submits that the petitioner herein suppressing about the pendency of appeal

and other proceedings has obtained the interim order and under the guise of

the said order, the police are interfering with the respondent No.5's possession

and that he has filed W.P.Nos.17054 and 31333 of 2021 before this Court and

this Court has disposed of the writ petitions by recording the submission of

learned Assistant Government Pleader for Home that the respondent police are

not interfering with the civil disputes.

5. As far as this writ petition is concerned, interim order of police

protection is already worked out and as such, no further orders required to be

passed in this Writ Petition.

6. Accordingly, the Writ Petition is closed. No order as to costs.

Miscellaneous applications, pending if any, shall stand closed.
