     TRANSFER CRIMINAL PETITION No.25 OF 2022

ORDER:

This Criminal petition is filed by the petitioner/accused

to withdraw STC.No.181/2022 on the file of Judicial

Magistrate of First Class at Warangal and to transfer the

same to the Judicial Magistrate of First Class at Sangareddy.

The main grievance of the petitioner/accused is that he

has to travel all the way from Warangal and that the other

proceedings including arbitration proceedings are pending on

the file of Judicial Magistrate of First Class at Sangareddy.

Learned Counsel for the petitioner submits that there is

advocate before the lower Court who is looking after his case.

In the said circumstances, it is directed that the trial

Court shall not insist upon the appearance of this petitioner

unless required for the purpose of either under Section 251

and 313 of Cr.P.C. or at the time of Judgment. However, the

petitioner shall not misuse this order to seek condonation of

proceedings in the trial Court.

Accordingly, the Criminal Petition is disposed off.

Miscellaneous applications, if any, pending shall stand

dismissed.
