                SECOND APPEAL No.574 of 2001

JUDGMENT:-

1.

The present second appeal is filed against the judgment

and decree dated 09.08.2000 in A.S.No.26 of 1995, on the file of

the Court of District Judge, Medak at Sangareddy.

2. On 13.06.2022, a memo was filed by the counsel for

appellant informing the Court about the death of sole appellant

long back and further informed that the matter is settled.

Inspite of specific direction given by this Court on 08.06.2022

directing the appellant to file death certificate of sole appellant

and to take steps to bring the LRs of sole appellant on record,

no positive action is taken. There is no representation from the

counsel for appellant inspite of the matter being listed under

the caption "For Dismissal". In the said circumstances, this

Court feels that the appellant is not willing to prosecute the

case.

3. In the result, the Second Appeal is dismissed for non-

prosecution. There shall be no order as to costs.

4. Miscellaneous petitions, if any pending in this appeal,

shall stand closed.
