THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI
W.P.No.35297 of 2021
ORDER: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel for the petitioner, at the outset, has
informed this Court that an appeal preferred by the petitioner i.e.,
Appeal No.FPA-PMLA-1657/DLI/2017, is pending before the
Appellate Tribunal for Forfeited Properties (Appellate Tribunal
under Prevention of Money Laundering Act) at New Delhi. Learned
counsel has also stated that the petitioner has filed an application
for grant of stay dated 01.02.2017. Her contention is that the
appeal has been heard finally, however no judgment has been
delivered so far.
Learned counsel for the other side has fairly stated before
this Court that the present petition can be disposed of accepting
the prayer made by the petitioner for an early disposal of the
appeal.
Hence, without commenting upon the merits of the case, the
present writ petition stands disposed of with a request to the
Appellate Tribunal to decide the appeal, as expeditiously as
possible, preferably within a period of three months from the date
of receipt of a certified copy of this order.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
