JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
23.02.2010 passed by the learned Single Judge in W.P.No.1052
of 1998.
In the present case, a show cause notice was issued by
the respondent No.1/Executive Officer, Mallikarjuna Swami
Vari Devasthanam, Inavolu, Warangal District on 03.12.1997
and a reply was also filed by the appellant on 23.12.1997. The
learned Single Judge has disposed of the writ petition directing
the respondent No.1 to proceed ahead in accordance with law.
No final order has been passed in the matter till date.
Sri S. Rahul Reddy, learned counsel appearing for the
appellant, has argued before this Court that the Executive
Officer was not competent to issue any show cause notice.
The fact remains that we are in the year 2022 and no
such final order has been passed in the matter. Therefore, in
case any final order is passed in the matter, the appellant shall
be free to raise all possible grounds, including the grounds
raised in the present writ appeal, by challenging the aforesaid
order.
With the aforesaid, the writ appeal stands disposed of.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
