THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI
WRIT APPEAL No.838 of 2009
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
10.03.2008 passed in W.P.No.2867 of 2007.
The facts of the case reveal that the respondents before this
Court have preferred a writ petition being aggrieved by non-grant
of regularization, as they were over aged. The learned Single Judge
keeping in view the order passed in W.P.No.8259 of 2007 and
batch dated 07.12.2007 has disposed of the writ petition only with
a direction to consider the case of the employees for grant of age
relaxation for the purpose of regularisation/regular appointment.
In the considered opinion of this Court, as the direction was
only to consider the grant of age relaxation, this Court does not
find any reason to interfere with the order passed by the learned
Single Judge.
Accordingly, the writ appeal is dismissed.
Miscellaneous petitions, if any, shall stand closed. There
shall be no order as to costs.
