WRIT PETITION No.8155 OF 2014
ORDER:
This Writ Petition, under Article 226 of the Constitution of
India, is filed seeking writ of Mandamus declaring the action of
the respondent No.4 in registering crime against the petitioner
vide COR No.479 of 2013-2014 for the offence under Section 8
(c) read with 22 of the Narcotic Drugs and Psychotropic
Substances Act, 1985, as arbitrary, illegal and consequently, to
set aside the same.
2. Heard learned counsel for the petitioner, learned Assistant
Government Pleader for Home, appearing for the respondents
and perused the record.
3. In the course of submissions, learned Assistant
Government Pleader for Home brought to the notice of this Court
that the subject crime ended in acquittal vide Judgment, dated
12.04.2018 passed in N/S.C.No.1 of 2016 by the I Additional
Sessions Judge, Nizamabad and therefore, the cause in the Writ
Petition does not survive for adjudication.
4. The said submission of learned Assistant Government
Pleader for Home is taken on record.
5. Since, it is stated that the subject crime ended in acquittal,
no further orders are required to be passed in this Writ Petition.
6. Accordingly, the Writ Petition is dismissed as infructuous.
Miscellaneous Petitions, if any, pending in this Writ
Petition shall stand closed. There shall be no order as to costs.
