Order

16/03/2026 The instant bail application under Section 483 of the BNSS

has been filed on behalf of the petitioner seeking interim bail for a

period of two months on the ground of performing the last rites

and rituals of his deceased grandmother.

This Court, after perusing the case file and the material

available on record, finds that the petitioner is facing trial for the

offences punishable under Sections 302 and 120-B of the IPC. The

ground urged by the petitioner for seeking interim bail is the

demise of his grandmother and his desire to participate in the last

rites and rituals.

However, from the submissions made and the material

placed before the Court, it appears that there are other family

members available who are capable of performing the said last

rites and rituals. In such circumstances, the personal presence of

the petitioner does not appear to be indispensable for the

performance of the said ceremonies.

It is also pertinent to note that interim bail is granted only in

exceptional circumstances when the Court is satisfied that

sufficient and compelling grounds exist. In the present case, the

ground urged by the petitioner does not constitute such

exceptional circumstances warranting the grant of interim bail,

particularly in view of the seriousness of the offence alleged

against him.

Accordingly, this Court is of the considered opinion that no

sufficient ground is made out for granting interim bail to the

petitioner.

Hence, the present interim bail application stands rejected.
