Order
13/03/2026
1. Present writ petitions have been filed by owners of plots
situated upon land bearing Khasra No. 3857, challenging order
dated 14.06.2018 passed by Land Acquisition Officer cum Sub-
Divisional Officer, Shahpura, Bhilwara, whereby their names have
been included in acquisition proceedings initiated for acquisition of
land including Khasra No. 3857. for the purposes of construction
of By-pass road.
2. In reply filed to present writ petition on behalf of
respondents, it is stated that present bunch of writ petitions has
been preferred seeking payment of compensation, in lieu of
aforementioned acquisition proceedings, to subsequent purchasers
of plots situated at Khasra No. 3857, which, was already under
acquisition. It is further stated that earlier, land bearing Khasra
No. 3857 was sought to be acquired for the purpose of
construction of Shahpura By-pass Road. However, said acquisition
proceedings lapsed and land of Khasra No. 3857 was not acquired.
Learned counsel for the respondents also submits that, in view of
alignment of proposed Shahpura By-pass Road, a fresh acquisition
notification was issued and the same does not include Khasra No.
3857. It is also stated that award of compensation has also been
declared in favour of persons whose land has been acquired
pursuant to such fresh notification.

3. Learned counsel for the respondents has thus argued that
adjudication in present case is not required to be done as land
bearing Khasra No. 3857 has not been acquired and the relief
sought by petitioners no longer survives in view of subsequent
events.
4. Learned counsel for the petitioners also concedes to the
truth of aforesaid factual averments and submits that in view of
subsequent development, present bunch of writ petitions has
virtually been rendered infructuous.
5. Accordingly, present writ petitions are dismissed as having
become infructuous.
6. Stay application and all other pending applications, if any,
also stand disposed of.
