Order

10/03/2026 Learned counsel for the petitioner has preferred the present

Criminal Miscellaneous Petition being aggrieved by the order dated

31.05.2025 passed by the learned Family Court No. 01, Udaipur in

Case No. 350/2023, whereby the learned trial Court directed the

petitioner to pay a sum of Rs.5,000/- as interim maintenance to

respondent No.2 from the date of filing of the application under

Section 125 of the Cr.P.C.

Learned counsel for the petitioner submits that respondent

No.2 is residing with some other person and these issues are to be

decided at the time of final hearing of the case. So far as the

interim maintenance of Rs.5,000/- is concerned, the same has

been wrongly awarded.

In the circumstances of the case, this Court has considered

the order dated 31.05.2025 and finds no reason to interfere with

the same. The order passed by the learned trial Court is a

reasoned and speaking order.

In view of the above, the instant Criminal Miscellaneous

Petition stands disposed of.

However, the learned trial Court is directed to decide the

main petition as expeditiously as possible, preferably within a

period of six months. The petitioner shall be at liberty to raise all

his contentions before the concerned Court in the main petition.
