Order

09/03/2026 Learned counsel for the petitioner submits that on

20.03.2025 the petitioner was present before the Court; however,

as the cost had not been paid, he was not permitted to cross-

examine the complainant, and an opportunity was granted for the

subsequent date. It is further submitted that on 18.09.2025, by

the time the petitioner reached the Court, the order sheet had

already been drawn and, in such circumstances, the cross-

examination was closed. He submits that the petitioner is ready

and willing to pay the cost and prays that the opportunity to

cross-examine may be reopened.

This Court has considered the matter and perused the orders

dated 20.03.2025 as well as 18.09.2025. In the interest of justice,

this Court deems it appropriate to grant one last opportunity to

the petitioner to cross-examine the complainant, as in the absence

of such opportunity the petitioner would not be able to properly

put forth his defence and his rights would be prejudiced.

However, since the petitioner did not pay the cost earlier, this

Court directs the petitioner to pay a cost of Rs. 3,000/- to the

complainant on the next date of hearing. Upon payment of the

said cost, the petitioner shall be permitted to cross-examine the

complainant.

Only one opportunity is granted to the petitioner, and no

further chance shall be granted by the learned trial Court.
