1. The present temporary suspension of sentence application
has been filed by the applicant-appellant under Section 430 BNSS
(389 of Cr.P.C.) seeking temporary suspension of sentence
awarded to him by learned Additional Sessions Judge (Women
Atrocities Cases), Jodhpur Metropolitan (hereinafter referred to as
'trial Court') vide order dated 01.12.2023 passed in Session Case
No.64/2017, during his examination for Master of Arts (Hindi)
scheduled to be held from 09.01.2026 to 03.02.2026.
2. Learned counsel for the applicant-appellant submits that the
applicant-appellant is appearing in Master of Arts (Hindi)
examination scheduled to be held from 09.01.2026 to 03.02.2026.
He submits that at present the accused-applicant is lodged at
Open Air Camp, Pali and the center of examination is at Jodhpur,

therefore, he may be permitted to leave the Open Air Camp, Pali
at 9:00 a.m. and permitted to surrender at 9:00 p.m. on the dates
of examination aforesaid.
3. Learned Public Prosecutor has verified the factum of
applicant-appellant appearing in the Master of Arts (Hindi)
examination scheduled to be held from 09.01.2026 to 03.02.2026.
4. We have considered the submissions made at the bar and
have gone through the relevant record of the case.
5. In view of the aforesaid, the present application seeking
temporary suspension of sentence is allowed and it is ordered that
the substantive sentence passed by the learned trial court vide
judgment dated 01.12.2023 passed in Session Case No.64/2017
against the applicant -Dashrath Singh S/o Shri Rewant Singh
shall remain temporarily suspended from 9:00 a.m. to 9:00 p.m.
on each day of examination of Master of Arts (Hindi) i.e. from
09.01.2026 to 03.02.2026 provided he executes a personal bond
in the sum of Rs.1,00,000/- (Rupees One Lakh Only) with two
sureties in the sum of Rs.50,000/-(Rupees Fifty Thousand Only)
out of which one surety will be of his close relative, each to the
satisfaction of the concerned Superintendent Open Air Camp, Pali
on usual conditions.
6. Let this application seeking temporary suspension of
sentence be again listed on 16.02.2026, and on that date,
learned Public Prosecutor and learned counsel for the petitioner
shall submit the compliance of this order.
