Heard learned counsel for the parties and perused the
material available on record.
The petitioner has been arrested in connection with FIR
No.13/2025 of Police Station Ogna, District Udaipur for the
offences punishable under Sections 126(2), 115(2) and 64(1) of
BNS. He has preferred this bail application under Section 483 of
BNSS.
Learned counsel for the petitioner has preferred the present
second bail application. The earlier bail application was not
pressed by him on 26.11.2025 with liberty to file the fresh after
recording of the statement of the prosecutrix. Learned counsel
submits that the statement of the prosecutrix has been recorded
on 08.01.2026 and she has truned hostile. She was the star
witness and has not supported the story of the prosecution at all.
He submits that in view of the same, there are no chances of
conviction and the conclusion of the trial is likely to take time,
therefore, the petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor has vehemently
opposed the bail application.
This Court has considered the rival contentions of both the
parties and gone though the material available on record as well
as statements of the prosecutrix recorded on 08.01.2026. The
prosecution has not supported the story of the prosecution and
has been declared hostile. In her statement, she has categorically
stated that no such incident had occurred and that no rape was
committed by the accused. The conclusion of trial of the case is
likely to take time, and the proseuction has not shown any
apprehension of the petitioner fleeing away from justice, in case
he is enlareged on bail. Having regard to the totality of the facts
and circumstances of the case, but, without expressing any
opinion on the merits of the case, I deem it just and proper to
grant bail to the petitioner under Section 483 of BNSS.
Accordingly, this bail application filed under Section 483 of
BNSS is allowed and it is directed that petitioner -Ranjeet
Singh shall be released on bail in connection with FIR No.13/2025
of Police Station Ogna, District Udaipur, if not wanted in any other
case, provided he executes a personal bond in the sum of
Rs.50,000/- with two sound and solvent sureties of Rs.25,000/-
each to the satisfaction of learned trial court for his appearance
before that court on each and every date of hearing and whenever
called upon to do so till the completion of the trial.
