Order

1. The petitioners have filed these bail applications under
Section 483 of BNSS in FIR No.416/2025 registered at Police
Station Raisinghnagar, District Sri Ganganagar for offence under
Sections 308(2), 308(4), 308(5), 111(4), 111(6), 111(7) and
61(2) of BNS-2023.
2. Since all these bail applications arise out of common FIR,
hence, they are being decided by this common order.
3. Heard learned counsel for the petitioners as well as learned
Public Prosecutor and perused the material available on record.
4. Learned counsel for the petitioners submits that the
petitioners have falsely been implicated in these cases. They
further submit that on the basis of the disclosure statement of the

co-accused, who have been named in the FIR, the name of the
present petitioners have been impleaded in the present case. It is
submitted that neither the petitioners were found present at the
place of occurrence nor any recovery has been effected from
them. There is never a single person aggrieved, who has levelled
allegation of extorting money. He again submitted that nothing
specific material is available on record, which is incriminatory
against the present petitioners. The offence under Section 111 of
BNS about organized crime is added just to enhance the gravity of
the prosecution story. However, as per Section 111 of the BNS,
the existence of an "organized crime" requires proof of continuing
unlawful activity, which mandates that more than one charge-
sheet must have been filed before a competent Court within the
preceding period of ten years. All petitioners have a clean record,
and no such prior charge-sheets exist against them. Thus, on false
and concocted grounds, the petitioners have been wrongly
implicated in the present case. The petitioners are behind bars
since 31.12.2025 and the trial of the case will take considerable
time, therefore, no fruitful purpose would be served by keeping
the petitioners in further custody and the bail application of the
petitioners may be allowed.
5. Learned GA-cum-AAG has vehemently opposed the bail
application.
6. On consideration of the rival submissions and material
available on record and in the light of submission made by learned
counsel for the petitioners but without expressing any opinion on
merits/demerits of the case, I am inclined to grant benefit of bail
to the petitioners.

7. Consequently, the bail applications under Section 483
B.N.S.S. are allowed and it is directed that the petitioners - (1)
Manish S/o Rajesh Kumar (2) Jaimalram S/o Sultanram (3)
Ghanshyam S/o Sh. Saheb Ram (4) Jaipal S/o Suganchand
(5) Yogesh Kumar S/o Sh. Kuldeep be released on bail
provided each of them furnishes a personal bond in the sum of
Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to
the satisfaction of the learned trial court with the stipulation that
they shall appear before that Court on all subsequent dates of
hearing till conclusion of the trial.
