1. The petitioner has filed this bail application under Section

483 of BNSS in FIR No.43/2025 registered at Police Station

Bakhasar, District Barmer for offences under Sections 332(2),

64(2)(F), 115(2), 126(2), 64(2)(M) & 308(6) of BNS.

2. Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioner submits that the petitioner

has falsely been implicated in this case. He further submits that

the present matter is of consensual in nature which is evident

from the FIR itself which shows that the petitioner and the victim

was in relationship for the last three years. He again submits that

in this matter, FIR has been lodged on 14.07.2025, but prior to

this FIR, petitioner himself lodged a complaint before the

concerned SHO on 03.07.2025 advancing allegations against the

victim for demanding 20 lacs rupees, making false case of honey-

trap. Above fact is verified by the then C.O. Mr. Jeeven Lal present

in person. Learned counsel further submits that there are several

call details between the petitioner and victim which again shows

their regular contact. He further argued that the victim is major

lady having two children and the petitioner is also a married

person and just to avoid the complaint about honey-trap,

petitioner has been implicated on false and concocted grounds

which is evident from the record. He again submits that the

petitioner is behind the bars since 27.09.2025 without any

criminal past and charge-sheet has been filed. The trial of the case

may take considerable time and no further custodial interrogation

is required, hence the bail application of the petitioner may be

allowed.

4. Learned Public Prosecutor as well as learned counsel for the

complainant vehemently opposed the bail application.

5. On consideration of the rival submissions and material

available on record and in the light of submission made by learned

counsel for the petitioner but without expressing any opinion on

merits/demerits of the case, I am inclined to grant benefit of bail

to the petitioner.

6. Consequently, the bail application under Section 483

B.N.S.S. is allowed and it is directed that the petitioner

Gorkharam S/o Hanuman Ram, be released on bail provided he

furnishes a personal bond in the sum of Rs.50,000/- with two

sureties in the sum of Rs.25,000/- each to the satisfaction of the

learned trial court with the stipulation that he shall appear before

that Court on all subsequent dates of hearing till conclusion of the

trial.
