1. Learned counsel for the petitioner has preferred the present

transfer application for transferring the case, which is pending

before the learned Additional Chief Judicial Magistrate, Bheem,

District Rajsamand to the Court of learned Chief Judicial

Magistrate, Beawar on the ground that the place where petitioner

resides is about 70 Kms. away from the Court at Bheem and the

husband of the petitioner had expired and petitioner is Senior

Citizen.

2. It is thus prayed that considering the circumstances as

stated above, the proceedings pending before the learned

Additional Chief Judicial Magistrate, Bheem, District Rajsamand be

transferred before the learned Chief Judicial Magistrate, Beawar.

3. Learned Public Prosecutor vehemently opposes the transfer

petition.

4. Heard learned counsel for both the parties and perused the

material available on record.

5. It is noted that the present transfer petition has been filed

on account of the factum of death of petitioner's husband, who

expired on 13.08.2019 and the present petition has been filed in

the year 2025. It is also to be noted that petitioner is aged about

49 years.

6. In view of the above, this Court finds no justification to

transfer the pending case at this juncture.

7. Resultantly, there is no merit in the present petition and the

same is hereby dismissed.

8. All pending applications, if any, also stand disposed of.
