1. This writ petition has been filed by the petitioner with the

following prayer:-

"It is therefore, most respectfully prayed that this writ petition may kindly be allowed and by an appropriate writ and directions, as it is deemed appropriate by this Hon'ble Court:-

1. The respective respondents may kindly be directed to call and disclose the final report of the respondent FSL in the case of the petitioner; and

2. The respective respondents may kindly be ordered to grant the offer of appointment in favour of the petitioner, in addition to the direction to grant notional appointment from the date, the appointment was given to the others, who were selected & appointed in the same selection process pursuant to the aforesaid advertisement dated 10.08.2022 along with entitled to deemed seniority and pay fixation from his notional date of appointment and all the other consequential benefits from the due date, and

3. Any other order or direction, which this Hon'ble Court deems it just, fit and proper to pass, in the light of the present set of facts and circumstances of the matter, may kindly be passed in the favour of the petitioner."

2. At the outset, learned counsel for the respondents submits

that during the pendency of the writ petition, petitioner has been

appointed on the post of Sub-Inspector in Delhi Police and Central

Armed Police Forces (CAPFs).

3. Learned counsel for the petitioner has not disputed the fact

that the appointment order has been given to the petitioner, yet

raises a grievance that as the appointment was withheld arbitrarily

and illegally by the respondents, petitioner is entitled for notional

benefits of pay fixation and seniority from the date on which other

similar situated persons qua the petitioner have been given

appointment pursuant to the same recruitment process. It is

submitted that in the similar circumstances, High Court of

Himachal Pradesh in CWP No.2386/25 (Kamal Kishore vs.

Union of India & Ors.) has delivered the judgment dated

30.06.2025 for permitting benefit of deemed seniority, pay fixation

and notional benefit.

4. Heard learned counsel for the parties and perused the

record.

5. It has not been disputed that petitioner has already been

appointed on the post of Sub-Inspector/General Duty in CRPF ,

Hence, the relief sought by the petitioner in this regard has

become infructuous.

6. However, for the purpose of grant of notional benefits of

seniority and pay fixation, the petitioner shall be at liberty to

submit a representation before the respondents in light of the

above aforesaid judgment of Kamal Kishore (supra) passed by the

High Court of Himachal Pradesh and in case, such representation

is filed, the same shall be considered and decided by the

respondents by a speaking order within a period of six weeks from

the date of receipt of representation along with certified copy of

this order.

7. The writ petition shall stand disposed of.

8. Pending application(s), if any, shall stand disposed of.
