09/04/2026

1. The Rajasthan Staff Selection Board initiated and conducted

a recruitment process for the post of Teacher Grade-III Level-II

pursuant to advertisement dated 16.12.2022 notifying 27,000

vacancies spread across various categories and subjects.

2. The appellants herein appeared in the aforesaid competitive

examination and were selected on the basis of their merit.

Appointment orders were duly issued in their favour, pursuant to

which, they joined their respective posts between September &

October, 2023 and are said to have been diligently discharging

their duties.

2.1 However, certain unsuccessful candidates, aggrieved by the

result of the said examination, called in question the validity of

certain questions that appeared in the examination paper. The

challenge gave rise to a batch of writ petitions before the learned

Single Bench. By the order impugned in those writ petitions, the

learned Single Bench disposed of the said petitions, issuing a

direction to the effect that the Expert Committee may re-examine

the matter, taking into account the submissions advanced before

the Court, and thereafter pass appropriate orders with respect to

the objectionable questions and the consequential revision of

result.

3. At the threshold, learned counsel for the appellants submits

that the appellants do not assail the revision of the result, which is

the sole outcome of the impugned order, but the whole anxiety of

the appellants is that in pursuance of compliance of such order,

the respondents acting in accordance with the report of the expert

committee have revised the result, which may lead to ouster of

the appellants, who are already selected and appointed

candidates.

4. Per contra, learned counsel representing the respondents

submit that once the appellants are not aggrieved by the

impugned order of expert committee and consequential revision,

then it was not open for them to bring a special prayer and rather

in case, any question of ouster arose, it was a fresh cause of

action, which they could have agitate.

4.1 Learned counsel further submits that at present no ouster

has in fact taken place and rather the State Government has

already moved proposal seeking sanction of 1301 posts to ensure

that the ouster on revision of result does not impact the

candidates, who are already selected.

5. Learned counsel for the appellants has drawn the attention

of this Court to Annexure-G, which is the order of the respondents

dated 14.11.2025. The operative portion of the said order is

reproduced hereunder:

6. This Court, upon due consideration of the limited

submissions advanced at the Bar, is of the considered opinion that

once the constitution of the expert committee and consequential

revision of the result has not been challenged by the appellant,

then nothing survives as far as challenge to the impugned order is

concerned. The apprehension of the appellants that there may be

an ouster as a consequence of such revision of the candidates,

who were selected on merits such as appellants, cannot be

addressed on the basis of mere apprehension and furthermore,

there was no foundation of the same before the learned Single
