1. Heard learned counsel for the parties.

2. The present habeas corpus petition has been filed by the

petitioner, who is the husband of the corpus Mst. 'N' and it is

stated that the corpus Mst. 'N' along with her two minor children

are in illegal detention of the respondent No.4.

3. In pursuance of the direction issued by this Court, the corpus

Mst. 'N' has been produced before us.

4. We have conferred with the corpus Mst. 'N'. The corpus Mst.

'N' is a major married lady having two minor children. She has

stated before us that the petitioner used to assault her and,

therefore, she has left her matrimonial home and is living

peacefully with the respondent No.4 of her own choice without any

pressure from any side. She has also stated that she is not under

illegal detention of the respondent No.4 as she is living with him of

her own free will.

5. In view of the statements made before us by the corpus Mst.

'N', we are convinced that she is not in illegal detention of the

respondent No.4. Thus, there is no force in the present habeas

corpus petition and the same is hereby dismissed.
