1. After arguing the matter to some extent, learned counsel for
the petitioner seeks withdrawal of the writ petition and prays for
issuance of certain directions to the respondents to decide the
respresentation to be submitted by the petitioner raising all his
grievance.
2. The prayer seems to be genuine. Accordingly, the writ
petition is disposed of. The petitioner shall submit a
representation to the Managing Director of the respondent RSRTC
averring therein all those grounds, which have been raised in this
writ petition, within a period of 30 days. After receipt of the

representation, the Managing Director would consider the same in
accordance with law, rules, prevailing scheme and judgments,
particularly the judgment passed by this court in the case of
Kulvindra Singh Vs. The State of Rajasthan (S.B.C.W.P.
No.15367/2022 decided on 12.12.2022), as per which, no
charge sheet can be issued for less revenue generation. It is also
expected from the Managing Director that he would take note of
the legal aspect that minor penalty issues must have been decided
before superannuation of the incumbent. The representation shall
be decided objectively within a period of 60 dyas from the date of
receipt of the same. Nothing would preclude the petitioner to
approach this court again if the grievances are not addressed
suitably or persists in any manner. In case the representation
succeeds, consequential benefits shall follow. Delayed payment
and accruable interest shall also be taken note of.
