1. Heard learned counsel for the parties.
2. Since the present appeals arise out of a common order
passed by the learned Single Bench, therefore, the same are being
decided by this common judgment.
3. The present appeals have been filed against the order dated
27.02.2018 passed by the learned Single Judge, whereby, the writ
petitions preferred by the present appellants were dismissed as
well as against the order dated 24.10.2019 passed by the learned
Single Judge, whereby, the review petitions were also dismissed.
4. Briefly noted the facts in the present appeals are that in
pursuance of an advertisement/notification No.1/2013 dated
07.06.2013 issued by the State Government for selection to the
posts of Compounder/Nurse Grade Junior in Ayurveda, Unani and

Homeopathy, the appellants-petitioners applied for the same and
after completion of the selection process, when the appointments
were not offered to them, the writ petitions were filed.
5. The principal contention of learned counsel for the appellants
is that the State Government was under an obligation to complete
the selection process by giving appointment to all those
candidates for which the vacancies were advertised in the
advertisement/notification issued by it.
6. Learned counsel for the appellants submits that after
completion of the selection process, the State Government cannot
withhold the appointments to the posts advertised by giving
appointments only to 313 candidates. He further submits that the
reason for halting the appointment midstream is de hors the law.
He also submits that it is true that the appellants have no right to
seek appointment and it is within the sole domain of the State
Government to give appointment to the persons from the select
list. If the State Government decides otherwise, no mandamus
can be issued by the Court to the State Government directing to
offer appointment, but the rider is that refusing to offer
appointment should be on the reasonable grounds to be stated by
the State Government.
7. Learned counsel for the appellants further submits that in
the present case, the ground on which the selection process has
not been proceeded with by giving appointment to the candidates
named in the select list is contrary to Rule 4 (2)(a) of the
Rajasthan Ayurvedic, Unani, Homeopathy and Naturopathy Service
Rules, 1973 (hereinafter referred to as the 'Rules of 1973'). He
also submits that since the Rule 4 (2)(a) provides the power for

creation of any post permanent or temporary from time to time as
may be found necessary lies with the respondents department,
therefore, the State Government cannot stop the grant of
appointment to the selected persons on the ground of not
sanctioning these posts by the Finance Department.
8. Learned counsel for the appellants also submits that the
reason for which the appointments are being denied to the
appellants is not justified and is not in consonance with the Rules
of 1973. He, therefore, prays that the present appeals may be
allowed and the prayers made in the writ petitions may also be
allowed by giving directions to the State Government to offer
appointments to the appellants in pursuance of the selection
process undertaken in furtherance of the advertisement/
notification issued in the year 2013.
9. Per contra, learned counsel for the respondents submits that
the State Government has taken a policy decision in the matter
and after due deliberations with the Finance Department, it has
been decided that all the posts advertised in the notification of the
year 2013, cannot be filled-up on substantive basis in view of the
orders issued by the Finance Department refusing to grant
sanction for appointment on these posts. He further submits that
the said decision was taken after consultation with the Finance
Department and the authorities of the State Government and,
therefore, this Court may not interfere in the policy decision taken
by the State Government.
10. Learned counsel for the respondents also submits that after
threadbare discussions with the agencies involved for selection
process initiated by way of advertisement/notification dated

07.06.2013, a conscious decision has been taken for not filling-up
the complete posts as advertised in the advertisement/
notification. He, therefore, prays that the learned Single Bench
has rightly considered the matter in detail and has correctly
dismissed the writ petitions filed by the petitioners-appellants.
11. We have considered the submissions made at the Bar and
gone through the relevant record of the case.
12. The undisputed facts narrated above clearly show that in
pursuance of the advertisement/notification issued by the
respondents in the year 2013 for filling-up 1005 posts of
Compounder/Nurse Junior Grade in Ayurvedic/Unani/Homeopathy
and Naturopathy, the recruitment exercise was undertaken and
after completion of the selection process, the select list was
prepared and the names of the present appellants were in the
select list. However, out of the entire select list, 313 candidates
have been offered appointment by the State Government, but for
the remaining candidates, selection has not been carried forward
and the State Government has taken a decision to fill-in the
remaining posts on contractual basis through NRHM. The decision
of the State Government is on account of non-sanctioning of such
posts by the Finance Department. The policy decision to that
respect has been taken keeping in mind all the factors including
the factor of finance. The detailed decision in that respect has
been placed on record before the learned Single Bench, which has
been taken note of at paragraph-44 of the judgment. Learned
Single Bench has rightly taken the view that it will not be
appropriate for a writ court to interfere in the policy decision of
the Government, which appears to be well-reasoned and justified.

We are in complete agreement with the view taken by the learned
Single Bench.
13. We further note that even if the names of the appellants
have been reflected in the select list, the same will not create any
right in their favour for grant of appointment and no mandamus
can be issued to the State Government to offer them appointment
merely on the ground that their names have been reflected in the
select list. We also take note of the fact that in the advertisement/
notification dated 07.06.2013, it has been categorically mentioned
that the number of posts advertised in the advertisement/
notification can be reduced or increased, therefore, in that view of
the matter also, we are not impressed by the argument of the
learned counsel for the appellants that the reason given by the
State Government for not filling-up the posts is not in consonance
with the Rules of 1973.
14. In view of the discussions made above, the present special
appeals (writs) filed by the appellants are devoid of force and the
same are hereby dismissed.
