1. The present writ petition has been filed with a prayer that

the respondent-Department be directed to issue a 'No Objection

Certificate' in favour of the petitioner.

2. Learned counsel for the petitioner submits that vide

judgment dated 30.05.2023 (Annexure-3) passed in the earlier

writ petition preferred by the petitioner being S.B. Civil Writ

Petition No.9970/2021, the respondents had already been directed

to determine the amount of training expenses incurred upon the

petitioner and intimate the same to the petitioner. On such

intimation, the petitioner was to be granted three months' time to

deposit the same and on deposition of the said amount, the

respondent-Department was directed to issue a 'No Objection

Certificate'.

2. An appeal preferred by the State assailing order dated

30.05.2023 being D.B. Spl Application Writ No.72/2024 stood

dismissed vide order dated 05.04.2024 (Annexure-4). Certain

SLP's filed by the State before the Hon'ble Apex Court in other

identical matters also stood dismissed but then too, order dated

30.05.2023 has not been complied till date.

3. At this stage, the Court finds it relevant to note the

submission made by learned counsel for the respondents to the

effect that if the petitioner deposits the training expenses within a

period of two weeks from now, a 'No Objection Certificate' shall be

issued to the petitioner by the respondent Authorities.

4. However, in view of the facts as submitted, this Court is of

the clear opinion that the present writ petition for the same relief

which had already been granted to the petitioner vide order dated

30.05.2023, cannot be entertained. The remedy of the petitioner

lies somewhere else.

5. The present writ petition is hence, disposed of.

6. Stay petition and pending applications, if any, stand

disposed of.
